An H1 visa qualifies the right to an immigrant to temporarily work in the United States. It is a legal document which is issued by the U.S. government. The U.S. government allows H1B visa with an insight to augment the company’s staff by recruiting extremely competent foreigners.

An H1B visa is valid for three years and can be further extended to three more years. However, once this tenure of six years gets over, the applicant will have to leave the U.S. country and only after a gap of one year, he/she can again apply for next H1B visa.

Mostly, to get an H1B visa, the applicant must have the sponsorship of its employer. It is only after the U.S. Company, i.e. the employer, who hires a foreigner, submits specific documents, can applicants work in the United States. The company is required to submit a labor condition application form stating all the details of the occupation such as wages and other details. Thereafter, the company needs to fill form I-129 and submit it along with the application fees. Once the form I-129 gets approved, then the applicant can apply for H1B visa.

After all the documents have been submitted and an H1B visa is issued for the applicant, he/she cannot work for any other company in the U.S. However, in case, the applicant wishes to switch job, he/she can visit the U.S. Immigration office and apply for a new H1B visa. As per the new law, now the applicants can immediately start working on their new job after filing the H1B plea.
